These Terms of Service (“Terms”) govern access to and use of https://loftavelle.com and the related online store, content, features, products, and services (collectively, the “Services”).

The terms “Loftavelle,” “we,” “us,” and “our” refer to Loftavelle.

Our ecommerce store is hosted by Shopify, which provides the ecommerce platform used to make the Services available.

By accessing or using the Services or placing an order, you agree to these Terms and the policies incorporated by reference.

If you do not agree to these Terms, please do not use the Services.

1. Eligibility and Account Information

You must be at least the age required by applicable law to enter into a binding purchase contract, or otherwise have any permission or supervision required by applicable law.

You agree to provide current, accurate, and complete information when:

  • Creating an account;

  • Placing an order;

  • Providing billing or shipping information; or

  • Otherwise interacting with the Services.

You are responsible for protecting your account credentials and for activity conducted through your account.

Please notify us promptly if you believe your account has been accessed or used without authorisation.

2. Store Information and Incorporated Policies

The following Loftavelle policies form part of these Terms where applicable:

  • Privacy Policy;

  • Return and Refund Policy;

  • Shipping Policy; and

  • Contact Information.

These policies are available through https://loftavelle.com.

If there is a conflict between these Terms and a policy dealing specifically with a particular subject, the more specific policy will generally control for that subject, subject to mandatory applicable law.

3. Products and Product Information

We make reasonable efforts to describe and display products accurately.

However, actual product colours may vary because of:

  • Lighting;

  • Photography;

  • Screen settings;

  • Device or display differences; and

  • Normal manufacturing variations.

Measurements, dimensions, and size guidance are approximate unless expressly stated otherwise.

Customers should review the applicable:

  • Product description;

  • Materials;

  • Care instructions;

  • Dimensions;

  • Size information;

  • Price; and

  • Availability

before placing an order.

We do not represent that a product is manufactured, designed, or sourced in the United Kingdom or any other particular country unless the applicable product page expressly and accurately states that information.

Any statement concerning a product's:

  • Origin;

  • Environmental characteristics;

  • Certification;

  • Performance;

  • Health characteristics;

  • Safety characteristics; or

  • Other specific attributes

applies only where supported and expressly stated on the applicable product page.

Nothing in this section limits mandatory consumer rights concerning product safety, quality, fitness for purpose, conformity, or accuracy of description.

4. Prices, Currency, Taxes, and Promotions

Prices are displayed in the currency shown on the website or during checkout.

The currency and total amount displayed during checkout will apply to the order, subject to correction of obvious errors where permitted by applicable law.

Applicable taxes, delivery charges, and other mandatory charges collected by us will be displayed before the order is submitted where required.

Loftavelle provides free standard shipping where stated on the website or during checkout.

Any customs duties, import taxes, brokerage charges, or destination-specific charges not collected at checkout are handled in accordance with our Shipping Policy.

Prices and promotions may change prospectively without notice.

Any:

  • Discount;

  • Reference or comparison price;

  • Stock level;

  • Countdown;

  • Promotional statement; or

  • Limited-availability statement

will apply only where it is genuine and accurately described.

If a material pricing or listing error occurs, we may contact you before accepting or fulfilling the affected order.

Where permitted by applicable law, we may offer you the choice to:

  • Proceed with the corrected information; or

  • Cancel the affected item or order and receive the applicable refund.

Promotion-specific conditions may apply.

Where promotion-specific conditions conflict with these Terms, the promotion-specific conditions will control for that promotion, subject to mandatory applicable law.

5. Orders and Contract Formation

Submitting an order constitutes an offer to purchase the products included in that order.

An automated order confirmation acknowledges receipt of your order but does not necessarily mean that the order has been finally accepted.

To the extent permitted by applicable law, an order may be considered accepted when we:

  • Confirm fulfilment;

  • Dispatch the order; or

  • Otherwise expressly confirm acceptance.

Before submitting an order, customers should have an opportunity to review relevant order information and correct identifiable errors.

We may refuse, hold, or cancel an order for legitimate reasons, including:

  • Product unavailability;

  • Suspected fraud;

  • Unauthorised payment;

  • Payment failure;

  • Incorrect or incomplete customer information;

  • Delivery restrictions;

  • Material pricing or listing errors; or

  • Material violation of these Terms.

If Loftavelle cancels an order after payment has been captured, we will refund the applicable cancelled amount to the original payment method.

We may reasonably limit quantities purchased per customer, household, account, payment method, billing address, shipping address, or order where reasonably necessary to prevent fraud, unauthorised resale, or abuse.

Nothing in this section limits mandatory consumer rights arising after a contract has been concluded.

6. Payment

Payment methods available during checkout may be provided by Shopify or authorised third-party payment providers.

By submitting an order, you represent that you are authorised to use the selected payment method and authorise the applicable charges displayed before order submission.

Payment information is processed by Shopify and authorised payment providers according to their respective terms, security practices, and privacy policies.

Loftavelle does not ordinarily receive or store complete payment-card numbers.

We may conduct lawful:

  • Fraud-prevention checks;

  • Payment-verification checks; or

  • Order-verification checks

before fulfilling an order.

7. Shipping and Delivery

Orders are normally processed within 1–3 business days after payment authorisation and order confirmation.

After dispatch, standard delivery is normally estimated at 7–15 business days.

The estimated total delivery time is therefore generally approximately 8–18 business days.

Free standard shipping applies where stated on https://loftavelle.com or during checkout.

Delivery timeframes are estimates unless expressly stated as guaranteed.

Complete information concerning:

  • Shipping destinations;

  • Processing times;

  • Tracking;

  • Delivery delays;

  • Customs charges;

  • Lost shipments;

  • Damaged shipments;

  • Incorrect addresses; and

  • Other delivery matters

is contained in our Shipping Policy.

Where applicable UK consumer law applies, goods will be delivered within the agreed delivery period.

Where no different delivery period has been agreed, goods will generally be delivered without undue delay and within 30 days after the contract is concluded, as required by applicable law.

Nothing in these Terms transfers delivery risk or limits customer remedies earlier than permitted by applicable law.

8. Risk During Delivery

Where Loftavelle arranges the carrier and applicable UK consumer law applies, the goods generally remain at Loftavelle's risk until the customer, or another person identified by the customer to receive the goods, obtains physical possession.

Carrier tracking information may be considered when investigating a delivery issue, but tracking information does not override mandatory consumer rights.

Different rules may apply where a customer independently commissions a carrier that was not offered by Loftavelle, to the extent permitted by applicable law.

9. Returns, Refunds, and Cancellations

Loftavelle 30-Day Voluntary Return Policy

Eligible returns may generally be requested within 30 calendar days after delivery, subject to our Return and Refund Policy and applicable law.

Our Return and Refund Policy governs matters including:

  • Return eligibility;

  • Return procedures;

  • Return authorisation;

  • Return shipping responsibility;

  • Non-returnable goods;

  • Damaged or defective goods;

  • Incorrect or missing products;

  • Return inspection; and

  • Refund processing.

Loftavelle covers approved return shipping costs for verified:

  • Damaged products;

  • Defective products;

  • Materially misdescribed products; or

  • Incorrect products.

For preference-based returns under our voluntary return policy, customers are generally responsible for return shipping costs.

Examples include:

  • Change of mind;

  • Fit concerns;

  • Ordering the wrong size;

  • Ordering the wrong colour; or

  • No longer wanting the item.

Approved voluntary returns are not subject to a separate restocking fee.

10. UK Statutory Cancellation Rights

Where applicable UK distance-selling rules apply, consumers purchasing eligible goods online generally have a statutory right to cancel the contract without giving a reason.

For most eligible goods:

  • Consumers generally have 14 calendar days after receiving the goods to notify Loftavelle that they wish to cancel; and

  • After notifying Loftavelle, they generally have a further 14 calendar days to return the goods.

This statutory cancellation right exists independently of Loftavelle's voluntary 30-day return policy.

Certain products or contracts may be excluded from the statutory change-of-mind cancellation right where permitted by law.

Examples may include certain:

  • Personalised or custom-made goods;

  • Perishable goods;

  • Sealed hygiene-sensitive products after opening;

  • Unsealed software or sealed media; and

  • Other goods or services subject to a statutory exception.

A statutory cancellation exception does not remove rights relating to faulty, misdescribed, or otherwise non-conforming goods.

11. Refunds Following Statutory Cancellation

Where an applicable UK statutory cancellation right has been validly exercised, reimbursement will be provided within the period required by applicable law.

For returned goods, reimbursement will generally be made no later than 14 days after we receive the goods back, or after the customer provides appropriate evidence that the goods have been sent back where applicable.

Where permitted by law, we may withhold reimbursement until:

  • We receive the goods back; or

  • The customer provides appropriate evidence of return.

Where the customer paid for delivery, an applicable statutory cancellation refund generally includes the cost of the least expensive standard delivery method offered for the order.

Any additional amount paid solely because the customer selected:

  • Express delivery;

  • Expedited delivery;

  • Priority delivery; or

  • Another more expensive delivery method

generally does not have to be refunded above the cost of standard delivery, unless applicable law requires otherwise.

Refunds will generally be made using the same payment method used for the original transaction unless another method is expressly agreed.

12. Order Changes and Cancellations Before Dispatch

Please include your order number.

We will make reasonable efforts to accommodate your request, but changes or cancellations cannot be guaranteed once processing or fulfilment has begun.

If Loftavelle cancels an order after payment has already been captured, the applicable amount will be refunded.

Nothing in this section limits mandatory statutory cancellation rights.

13. Faulty, Misdescribed, or Non-Conforming Goods

Nothing in these Terms limits rights available under the Consumer Rights Act 2015 or other applicable UK consumer law.

Goods supplied by Loftavelle should be:

  • Of satisfactory quality;

  • Fit for purpose where applicable; and

  • As described.

Where goods are faulty, misdescribed, unsafe, or otherwise fail to meet applicable statutory requirements, consumers may be entitled to remedies independently of Loftavelle's voluntary return policy.

Depending on the circumstances and applicable law, remedies may include:

  • Short-term rejection and refund;

  • Repair;

  • Replacement;

  • Price reduction;

  • Final rejection and refund; or

  • Another remedy required by law.

For qualifying non-conforming goods, UK consumers generally have a 30-day short-term right to reject, subject to applicable legal conditions.

The expiry of Loftavelle's voluntary 30-day return period does not automatically end statutory rights concerning faulty or non-conforming goods.

Any commercial warranty or guarantee is additional to, and does not replace, mandatory statutory rights.

14. Customer Communications, Reviews, and User Content

If you submit a:

  • Review;

  • Photograph;

  • Video;

  • Comment;

  • Suggestion;

  • Feedback; or

  • Other content,

you represent that:

  • You own the content or have permission to submit it;

  • The content is lawful;

  • Where represented as a review or personal experience, it reflects your genuine experience; and

  • It does not infringe another person's intellectual-property, privacy, or other rights.

You retain any ownership rights you have in content you submit.

To the extent permitted by applicable law, you grant Loftavelle a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, and use submitted content for purposes reasonably connected with operating, improving, and promoting the Services.

We do not require positive reviews and do not prohibit honest negative feedback.

We may remove or decline to publish content that is:

  • Unlawful;

  • Fraudulent;

  • Abusive;

  • Deceptive;

  • Irrelevant;

  • Infringing; or

  • Otherwise prohibited by applicable law or platform rules.

15. Acceptable Use

You must not use the Services to:

  • Violate applicable law or another person's rights;

  • Submit false, misleading, fraudulent, malicious, or unlawful information;

  • Interfere with website security, checkout functionality, networks, or another customer's use;

  • Introduce malware, viruses, harmful code, or malicious technology;

  • Attempt unauthorised access to systems, accounts, networks, or data;

  • Use unauthorised automated scraping, crawling, or data-extraction tools;

  • Impersonate another person or misrepresent your identity or affiliation;

  • Conduct payment fraud;

  • Knowingly engage in fraudulent or abusive chargeback activity;

  • Engage in unauthorised resale or fraudulent purchasing activity; or

  • Copy, reproduce, or commercially exploit website content beyond permissions granted by law or these Terms.

We may restrict or terminate access for material violations of these Terms, subject to applicable law.

Termination does not affect rights or obligations that arose before termination.

16. Intellectual Property

The Loftavelle name, branding, logos, website design, text, graphics, photographs, videos, product presentation, and other content made available through the Services are owned by Loftavelle, its licensors, or other applicable rights holders.

Such content may be protected by applicable:

  • Copyright;

  • Trademark;

  • Design;

  • Database; and

  • Other intellectual-property laws.

You may access and use the Services for lawful, personal, and non-commercial shopping purposes.

Except where expressly permitted by applicable law or these Terms, no ownership interest or intellectual-property licence is granted to you.

Third-party product names, trademarks, logos, and other intellectual property remain the property of their respective owners.

Their appearance through the Services does not necessarily imply sponsorship, affiliation, or endorsement unless expressly stated.

17. Third-Party Services and Links

The Services may use or link to independent third-party services, including:

  • Shopify;

  • Payment providers;

  • Delivery carriers;

  • Analytics providers;

  • Advertising platforms;

  • Social-media services; and

  • Other websites or online services.

Third-party services operate independently and may be governed by their own terms and privacy policies.

To the extent permitted by applicable law, Loftavelle is not responsible for independent third-party content, systems, or practices outside our reasonable control.

Shopify provides the ecommerce platform used by Loftavelle but is not the seller of products purchased directly from Loftavelle.

Questions concerning Loftavelle orders should therefore be directed to Loftavelle.

18. Privacy

Our collection, use, processing, retention, and disclosure of personal information are governed by our Privacy Policy available through https://loftavelle.com.

Our Privacy Policy explains matters including:

  • Personal information we collect;

  • Purposes and lawful bases for processing;

  • Cookies and similar technologies;

  • Marketing preferences;

  • Advertising practices;

  • International data transfers;

  • Data retention;

  • UK privacy rights; and

  • How to submit a privacy request.

19. Website Availability

We make reasonable efforts to keep the Services available and functioning properly.

However, we do not guarantee that website access will always be uninterrupted, secure, or error-free.

The Services may occasionally be unavailable because of:

  • Maintenance;

  • Technical problems;

  • Security incidents;

  • Third-party service disruption; or

  • Circumstances outside our reasonable control.

Nothing in this section excludes or limits statutory rights or responsibilities that cannot lawfully be excluded.

20. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

In particular, these Terms do not exclude or restrict liability for matters that cannot lawfully be excluded, including where applicable:

  • Fraud or fraudulent misrepresentation;

  • Death or personal injury caused by negligence where liability cannot lawfully be excluded;

  • Mandatory product liability;

  • Mandatory consumer-protection obligations; or

  • Other liability that applicable law requires us to bear.

Subject to the above and to the fullest extent permitted by applicable law, Loftavelle will not be responsible for indirect or consequential losses that were not reasonably foreseeable as a result of a breach.

Nothing in this section limits mandatory remedies relating to:

  • Faulty goods;

  • Non-conforming goods;

  • Unsafe products;

  • Misdescribed products;

  • Undelivered products; or

  • Other legally non-compliant goods.

Where a limitation is prohibited or unenforceable under applicable law, it applies only to the maximum extent legally permitted.

21. Responsibility for Unlawful Misuse

To the extent permitted by applicable law, you may be responsible for reasonable losses or costs directly resulting from:

  • Your unlawful misuse of the Services;

  • Your intentional infringement of another person's rights;

  • Fraudulent activity; or

  • Malicious conduct.

Nothing in this section makes a consumer responsible for losses caused by Loftavelle's own:

  • Breach;

  • Negligence;

  • Unlawful conduct; or

  • Failure to comply with mandatory legal obligations.

22. Fair and Transparent Terms

These Terms are intended to be fair, clear, and transparent.

Nothing in these Terms is intended to:

  • Create an unfair imbalance in the parties' rights and obligations;

  • Mislead consumers about their statutory rights;

  • Exclude a legal responsibility that cannot lawfully be excluded; or

  • Prevent a consumer from relying on a mandatory legal remedy.

If a provision conflicts with a mandatory consumer-protection rule, the mandatory rule will apply.

23. Electronic Communications

By placing an order or using the Services, you agree that transactional communications may be provided electronically.

These communications may include:

  • Order confirmations;

  • Receipts;

  • Shipping updates;

  • Return communications;

  • Refund notifications;

  • Account notices;

  • Security notices; and

  • Policy-related communications.

Marketing communications will be sent only as permitted by applicable law.

Where required, promotional communications will include an unsubscribe or opt-out mechanism.

Opting out of marketing does not prevent us from sending necessary transactional or service-related communications.

24. Governing Law and Consumer Rights

To the extent permitted by applicable law, these Terms and contracts concluded with Loftavelle are governed by the laws of England and Wales.

However, this choice of law does not deprive a consumer of mandatory protections that would otherwise apply under applicable law, including mandatory protections available in the consumer's usual place of residence where relevant.

Nothing in these Terms:

  • Excludes mandatory consumer rights;

  • Restricts an applicable statutory cancellation right;

  • Restricts mandatory rights concerning faulty or misdescribed goods;

  • Requires a consumer to waive a legal remedy that cannot lawfully be waived; or

  • Requires a consumer to bring proceedings exclusively in England and Wales where applicable law gives the consumer a right to proceed elsewhere.

Any dispute may be submitted to a court or other authority having lawful jurisdiction.

Customers are encouraged to contact Loftavelle before commencing formal proceedings so that we can attempt to resolve the matter.

Doing so does not waive, shorten, or restrict:

  • Any statutory deadline;

  • Any limitation period;

  • Any complaint right; or

  • Any other mandatory protection.

25. Severability, Waiver, and Entire Agreement

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in effect.

Failure by Loftavelle to enforce a provision does not constitute a waiver of that provision or any other right.

These Terms, together with the policies incorporated by reference, constitute the agreement governing use of the Services and purchases from Loftavelle, except for:

  • Terms expressly agreed separately in writing; and

  • Rights or obligations imposed by applicable law.

26. Changes to These Terms

We may update these Terms from time to time for:

  • Operational;

  • Legal;

  • Regulatory;

  • Security; or

  • Business reasons.

The current version will be published on https://loftavelle.com together with an updated “Last updated” date.

Changes generally apply prospectively.

Where applicable law requires additional notice or consent for a material change, we will provide such notice or obtain consent as required.

Changes will not retroactively remove or reduce rights relating to an order already accepted where doing so would be prohibited by applicable law.
